In\nfact, it states, \u201cExcessive bail shall not be required, nor excessive fines\nimposed, nor cruel and unusual punishments inflicted.\u201d Here in Indiana, bail\nmust be set by a judge within 20 days of the arrest. <\/p>\n\n\n\n<p>When it comes to setting bail, bail schedules are used, as\nmentioned. However, a judge can change things up as they please. Basically, a\njudge\u2019s decision in altering the bail schedule is influenced by all sorts of factors,\nincluding the nature of the charge, as well as, a defendant\u2019s criminal history,\ncurrent pending charges, age, likeliness to flee, employment, and more. But the\ntop 4 factors you need to be concerned about include:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2776 <strong>Severity of Offense<\/strong> <\/h2>\n\n\n\n<p class=\"has-medium-font-size\">\u2013 How serious is your charge?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2777  <strong>Criminal History<\/strong> <\/h2>\n\n\n\n<p class=\"has-medium-font-size\">\u2013 What types of arrests and convictions are on your record?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2778  <strong>Flight Risk<\/strong> <\/h2>\n\n\n\n<p class=\"has-medium-font-size\">\u2013 Will you flee while out on bail?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2779  <strong>Case Interference<\/strong> <\/h2>\n\n\n\n<p class=\"has-medium-font-size\">\u2013 Will you interfere with or intimidate the prosecution witness or community?<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Once Bail is Set<\/h1>\n\n\n\n<p>Once a judge sets a person\u2019s bail, that person can be\nprocessed into the jail system and then bonded out. They can choose to pay the\nentire bail amount in cash, and then receive their monies back when they\ncomplete all of their court-related obligations; or, they can pay a bail bond\ncompany a fraction of the bond amount, but this is a non-refundable fee. Most\npeople choose to use a bail bondsman because it is more convenient that giving\nup all your cash for a release from jail. Many people cannot afford to pay the\njail thousands of dollars, so paying a bail bondsman a few hundred is more cost-effective.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">When Bail is Denied<\/h1>\n\n\n\n<p>Bail can be denied for a number of reasons. A defendant is\nalmost guaranteed to have their bail rights revoked if they have a history of\nfailing to appear for their scheduled court hearings. Also, those in probation\nor parole are likely to have their bail privileges denied by a judge.
